Tom Cotton Asks Supreme Court to ‘Rein in Rogue Federal Justices’ Who Have ‘No Authority to Intervene’ – RedState

As leftist federal district judges continue to issue ruling after ruling against President Donald Trump’s executive orders as he attempts to fulfill his campaign promises to right the wrongs — reverse the insanity — of the intentional efforts of the Biden administration to destroy America as we know (knew?) it, Sen. Tom Cotton (R-AR) sat down for interview on this week’s edition of “Life, Liberty & Levin,” during which he warned that the situation will only worsen if the Supreme Court doesn’t intervene.





Needless to say, Cotton and host Mark Levin were on the same page.

First, here’s a bit of background:

The House on [April 9] passed a bill that seeks to rein in “rogue” district court judges, and limit their authority. The legislation, titled the No Rogue Rulings Act, [NRRA] passed by a 218-214 vote along party lines. One Democrat did not vote because of a medical issue.

The No Rogue Rulings Act would prevent a U.S. district court from issuing any “order providing for injunctive relief, except in the case of such an order that is applicable only to limit the actions of a party to the case before such district court with respect to the party seeking injunctive relief from such district court.”

It comes after Republican lawmakers called for liberal “rogue” justices to stop issuing nationwide injunctions, which has drastically impacted President Donald Trump’s agenda.

Rep. Darrell Issa (R-CA) introduced the No Rogue Rulings Act, which mirrors three other bills proposed by Sens. Chuck Grassley (R-IA), Mike Lee (R-UT), and Josh Hawley (R-MO).

The recent case rightly incenses conservatives comes after District Judge Paula Xinis in Maryland ordered the Trump administration to “facilitate and effectuate” the return of Salvadoran illegal alien Kilmar Abrego Garcia, who was deported back to El Salvador for “allegedly” belonging to the violent gang MS-13.





Cotton forcibly told Levin (emphasis, mine): 

This far-left Obama judge in Maryland is now demanding the president somehow sit down with a foreign leader and come to terms to return an MS-13 wife-beater. This judge has no authority to intervene in the president’s conduct of foreign policy. Even the Supreme Court said that she didn’t have that kind of authority.

A lot of these liberal judges, they love the limelight, they get tired of presiding over contract disputes or minor drug cases, so rather, they want to insert themselves into the conduct of foreign policy or stopping administrative action that applies not just in their own states but in the entire country. 

The Supreme Court needs to take steps to rein in these rogue federal judges that want to be policymakers as opposed to neutral jurists.

Bingo — the debate should be over. Make that “should never have been a question in the first place.”

To put the troublesome issue into perspective, according to the Congressional Research Service, as of March 27, judges had already handed down 17 more injunctions against the Trump administration, while former President Joe Biden faced just 14 throughout his entire presidency.
