Trump Team Issues ‘Blistering’ Response in Federal Court Over Tren de Aragua Deportations—Judge Unmoved – RedState

Trump administration lawyers filed a heated motion in federal court Monday demanding that the ACLU and U.S. District Judge James Boasberg stop interfering with his presidential authority.





As we’ve been reporting, President Trump invoked the 1798 Alien Enemies Act against members of the violent Venezuelan Tren de Aragua gang and promptly put over 200 of them on a plane to be taken to El Salvador. While the flight was still in the air, Boasberg ordered a temporary restraining order preventing the deportation of any Venezuelans—and he also demanded that the plane turn around and return the gangsters to the U.S. (Attorney General Pam Bondi has already appealed the ruling.) 

In the end, Trump opted not to order the plane to come back. Instead, he demanded the court vacate a hearing Monday. The meddling judge denied it of course; we’ll get to that momentarily.

The tweet from Fox News’ Bill Melugin continues:

“Plaintiffs cannot use these proceedings to interfere with the President’s national-security and foreign-affairs authority, and the Court lacks jurisdiction to do so…the Court should vacate the hearing and de-escalate the grave incursions on Executive Branch authority that have already arisen.”

The Trump admin also says they complied with the order by not removing the 5 plaintiffs, and that the judge’s verbal order was not legally binding. They say only the written order was, which they say they complied with.

Judge Boasberg—who many have been calling an activist who has no business in this case—was not swayed.

As Melugin reported, the Trump team is asking that Boasberg reassign the case because of his obvious bias:

“This court should also reassign this case to another district court judge given the highly unusual and improper procedures—e.g. certification of a class action involving members of a designated foreign terrorist organization in less than 18 hours with no discovery and no briefing from the government—that have been employed in the district court proceedings to date.”

Meanwhile, according to another report, King Judge Boasberg is demanding a written explanation of why the administration did not turn the planes around:





Government lawyers refused Monday to provide a federal judge any information about flights that deported hundreds of Venezuelans under national security grounds, but the judge who temporarily blocked the flights demanded a written explanation for the refusal by noon Tuesday.

As many including myself predicted, this promises to be yet another tortuous legal fight between Trump and those who wish to stop him. The good news is that he has a remarkable track record of winning. Let’s hope that’s what we see here.
